Content (Syllabus outline)
The subject covers the following topics:
– What is the philosophy and theory of law (definition of concepts or areas, the relationship between the concepts and the history of their development);
– An overview and understanding of the classical and contemporary theories of law, views on the nature of law: natural law, legal positivism, pure theory of law, legal realism, synthetic theory of law;
– Argument and legal argumentation: argument, validity and healthy argument, argumentative strategies, legal argumentation;
– Selected aspects of the philosophy and theory of law

Objectives and competences
The aim of the course is to develop and complement the fundamental knowledge in the field of the theory and philosophy of law acquired by students at Jurisprudence at the 1st level of law study. The objective of the course is to teach students the basics of the theory and philosophy of law, their development and interconnection. Furthermore, with the inclusion of legal argumentation, the goal is also to develop a broader understanding of the nature of law and to transfer the knowledge into practice.
Intended learning outcomes
The student:
– Learns the concepts of the theory and philosophy of law and the central substantive issues that are established within them;
– Deepens the ways of thinking about legal philosophical and theoretical issues and acquires the skills of critical thinking;
– Gets an insight into contemporary debates within the philosophy and theory of law
– Acquires the most common basic and additional interpretational and argumentative techniques;
– Learn about the method of legal decision-making in difficult legal cases.
Learning and teaching methods
Lectures with the active participation of students.
Assessment
The written examination is assessed.
